Studio Pieter Stockmans E-shop is owned and operated by Studio Pieter Stockmans and is the only official Studio Pieter Stockmans online store. Some other websites might also offer a selection of Studio Pieter Stockmans items but have no ties to our Group.

1. GENERAL
1.1. There is a valid agreement between you (“the Customer”) and STUDIO PIETER STOCKMANS upon the receipt of the confirmatory e-mail set out in article 3.1 (“the Agreement”). The Agreement will be governed by these terms and conditions.

2. PRICE AND PAYMENT
2.1. The prices listed in the Studio Pieter Stockmans E-shop are in Euro and include VAT. They do not include delivery charges, import taxes and insurance.
2.2. STUDIO PIETER STOCKMANS cannot be held liable for typing errors with regard to the prices. Only the price stated in the confirmatory e-mail is correct.
2.3. Prices are subject to changes. The Customer will be billed the price stated in the Studio Pieter Stockmans E-shop at the time the order was made.

3. SALE, DELIVERY, RIGHT OF WITHDRAWAL AND WARRANTY
3.1. A confirmatory e-mail will be sent shortly after the order has been processed.
3.2. The goods will be delivered by a third party. STUDIO PIETER STOCKMANS cannot be held liable for any late deliveries or items damaged, lost or stolen during delivery. The Customer shall carry the risk to the goods as of the delivery. STUDIO PIETER STOCKMANS shall retain title to the goods until full payment of the goods by the Customer.
3.3. The Customer shall have the right to communicate to STUDIO PIETER STOCKMANS that he withdraws from the purchase, without having to pay a penalty and without having to give any reason, within seven working days from the day that follows the delivery of the product. The Customer bears all costs related to the return of the goods to STUDIO PIETER STOCKMANS including, but not limited to loss, theft and damage during transport. 4. DISCLAIMER
4.1. All products and services made available on or through the Studio Pieter Stockmans E-shop are provided on an “as is” basis. The pictures and narratives may not give a full accurate description of certain aspects including, but not limited to, the colour tint. STUDIO PIETER STOCKMANS cannot be held liable for such inaccuracies.
4.2. STUDIO PIETER STOCKMANS will regularly update the list of the items pursuant to their availability. However, all products and services made available in or through the Studio Pieter Stockmans E-shop are provided on an “as available” basis. STUDIO PIETER STOCKMANS may, regardless of the confirmatory e-mail, cancel the order in case the items are no longer available. In such case, STUDIO PIETER STOCKMANS will issue a full credit to you.
4.3. STUDIO PIETER STOCKMANS cannot be held liable for any direct and indirect damage arising out of or related to the use of the Studio Pieter Stockmans E-shop including, but not limited to, a failure to process the order for technical reasons, unless such damages are due to the fraud or gross negligence of STUDIO PIETER STOCKMANS.
4.4. STUDIO PIETER STOCKMANS cannot be held responsible for any website linked to the Studio Pieter Stockmans E-shop. Any such website is independent from the Studio Pieter Stockmans E-shop. The Studio Pieter Stockmans E-shop has no control over, nor responsibility with respect to, the information provided or activities undertaken by any such website.
4.5. STUDIO PIETER STOCKMANS shall not be held liable or deemed to be in default for any delay or failure in performance of any obligation under the Agreement resulting directly or indirectly from force majeure. The term force majeure shall include war, terrorist acts, civil disturbance, fire, flood, unorganised strike, acts of governmental authorities, acts of God or any other causes or conditions beyond STUDIO PIETER STOCKMANS’s reasonable control.

5. UNLAWFUL CONDUCT
5.1. You agree that you are prohibited from posting or transmitting to the Studio Pieter Stockmans E-shop website any material that could give rise to any civil or criminal liability under the law. The Studio Pieter Stockmans E-shop reserves the right to seek all remedies available at law and in equity for violations of the Agreement, including the right to block access from a particular internet address to this website.

6. PROPRIETARY INFORMATION
6.1. STUDIO PIETER STOCKMANS shall remain the sole owner of all property rights on the content appearing on the website including, but not limited to, trademarks, trade names, graphics, logos, images, text, audio clips, icons, and computer software. You are only allowed to use the Studio Pieter Stockmans E-shop site for its intended purpose, which is for your retail use only as a consumer. Any other use of content from this website is strictly prohibited. Unless approved in advance and in writing, STUDIO PIETER STOCKMANS prohibits any links to other websites. Registered and unregistered proprietary information is owned and held by STUDIO PIETER STOCKMANS. Misuse of this website in any form may lead to legal action to the fullest extent.

7. TERMINATION OF THE USE OF THIS WEBSITE
7.1 STUDIO PIETER STOCKMANS reserves the right to terminate your access to our website at any time and at our sole discretion.

8. MINORS UNDER 18
8.1 If you are a minor under 18, you can use this service only under the supervision of your parents or guardians.

9. JURISDICTION
9.1 You agree that the Agreement is governed by the laws of Belgium. In addition, you agree to the exclusive personal jurisdiction and venue of the Belgian courts.

10. MISCELLANEOUS
10.1 Articles 2, 3, 4 and 6 of the Agreement shall survive the termination of the Agreement for a period of 5 (five) years.
10.2 If any provision of the Agreement is invalid, illegal or incapable of being enforced by any rule or law, or public policy, all other conditions of the Agreement will remain in full force and effect.
10.3 STUDIO PIETER STOCKMANS reserves the right to revise the terms and provisions set forth above at any time. All revisions will be published on the website and communicated to the Customer via e-mail.
